Consent for Emergency Treatment Agreement
Participant requests and is granted permission to participate in the Jumpstart Parent Conference on August 15, 2019, hereinafter called “Activity,” sponsored by The Classical Academy, Inc., Coastal Academy Charter School, Inc., Classical Academy High School, Inc. and North County Education Foundation, hereinafter collectively called “TCA.”
In consideration of being permitted to participate in any way in Activity, Participant, for himself/herself, his/her heirs, personal representatives or assigns, does hereby release, waive, discharge, and covenant not to sue TCA, its officers, employees, and agents from liability from any and all claims including the negligence of TCA, its officers, employees and agents, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in Activity.
Assumption of Risks: Participant acknowledges and fully understands that there are or may be hazards and risks incident to participation in this Activity that cannot be eliminated regardless of the care taken to avoid injuries including losses that may result not only from Participant’s own actions, inactions or negligence, but also from the actions, inactions or negligence of others, from the condition of the facilities, equipment, or areas where Activity is being conducted, and/or related to the specific type of activity. The specific risks vary from one activity to another, but the risks range from 1) minor injuries such as scratches, bruises, and sprains to 2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions to 3) catastrophic injuries including paralysis or death. Participant understands that TCA assumes no responsibility of any nature whatsoever for the actions of Participant or any other person or entity involved in this Activity.
Participant has read the previous paragraphs and knows, understands, and appreciates these and other risks that are inherent in the Activity. Participant hereby asserts that participation is voluntary and knowingly assumes such risks.
Indemnification and Hold Harmless: Participant also agrees to indemnify and hold TCA harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of his/her involvement in Activity or for contribution or indemnification with respect to any claim made against Participant by any other person or entity in connection with Activity, and to reimburse them for any such expenses incurred.
Consent for Emergency Treatment: Participant certifies that he/she is in good health and has no physical condition that would prevent participation in Activity. Participant authorizes TCA administrators, and its designated representatives to consent, on Participant’s behalf, to any emergency medical/hospital care or treatment to be rendered. Participant agrees to be responsible for all necessary charges incurred by any hospitalization or treatment rendered pursuant to this authorization. Participant understands that coverage is not provided by TCA.
Severability: Participant further expressly agrees that the foregoing is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgement of Understanding: Participant has read this waiver of liability, assumption of risk, consent and indemnity agreement, fully understand its terms, and understands that, by registering for Activity, he/she is giving up substantial rights, including the right to sue. Participant acknowledges that he/she is entering into this agreement freely and voluntarily, and intends it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
